“You”, “your” and “customer” refer to the person accessing the website, purchasing a product, placing a custom order or booking a workshop.
By using this website or placing an order, you agree to these Terms and Conditions, together with our Privacy Policy, Shipping Policy and Refund Policy.
If you do not agree with these terms, please do not use the website or place an order.
2. Eligibility to purchase
You must be at least 18 years old and legally capable of entering into a binding contract to purchase from this website.
If you place an order on behalf of another person, organisation or company, you confirm that you have authority to do so.
You are responsible for ensuring that the information provided during checkout is complete and accurate.
3. Handmade products and natural variations
Many Anubhuti products are individually painted, handmade, artist-finished or produced in small batches. Each handmade piece has its own character.
Minor differences may occur in:
-
Colour and shade
-
Brushwork and dot placement
-
Pattern alignment
-
Texture and surface finish
-
Dimensions and weight
-
Placement of embellishments
-
Appearance of natural or handmade materials
These variations are part of the handmade nature of the product and are not normally considered defects.
Colours may also appear differently depending on screen settings, lighting and photography. We make reasonable efforts to display products accurately but cannot guarantee that your device will reproduce every colour exactly.
Dimensions stated on the website are approximate unless expressly described as exact.
4. Product descriptions and availability
We aim to keep product descriptions, photographs, prices and availability accurate. However, occasional errors may occur.
We reserve the right to:
-
Correct a description, price or availability error
-
Update product information
-
Withdraw a product
-
Limit quantities
-
Decline or cancel an order affected by an obvious error
If an error materially affects an order you have already placed, we will contact you and allow you to confirm the corrected order or receive a refund.
Items placed in a cart are not reserved until payment has been completed and the order has been accepted.
5. Prices, currency and taxes
Prices are displayed in the currency shown on the website or at checkout.
Your bank, card provider or payment service may apply:
-
Currency-conversion charges
-
International transaction fees
-
Exchange-rate adjustments
-
Other processing charges
These third-party charges are outside our control.
Indian taxes will be applied where legally required. For international orders, import VAT, customs duties, brokerage charges and local handling fees may apply separately unless checkout expressly states that they are included.
6. Placing and accepting an order
After you place an order, you should receive an automated acknowledgement. This confirms that we have received your order but does not necessarily mean that it has been accepted.
An order is accepted when we:
-
Send an order confirmation;
-
Confirm a custom commission in writing; or
-
Dispatch the ordered product,
whichever occurs first.
We may decline or cancel an order where:
-
Payment is not authorised
-
A product is unavailable
-
The price or description contains an obvious error
-
We cannot deliver to the supplied address
-
We reasonably suspect fraud or unlawful activity
-
A requested custom design infringes another person’s rights
-
The order cannot be completed safely or lawfully
If payment has already been collected for an order we cannot accept, we will issue the appropriate refund.
7. Payment
Available payment methods are displayed at checkout.
Payment services may be provided by independent payment processors. We do not ordinarily receive or store complete card details.
You confirm that:
-
You are authorised to use the selected payment method;
-
The billing information supplied is accurate; and
-
Sufficient funds or credit are available.
Custom commissions, bulk orders and corporate orders may require a deposit or full advance payment. The applicable payment schedule will be stated in the quotation or order confirmation.
8. Custom and personalised orders
A custom or personalised order may include original artwork, name pieces, commissioned mandalas, customised gifts, corporate orders or products made according to your specifications.
Before starting work, we may ask you to confirm:
-
Size and materials
-
Colour palette
-
Names, dates or wording
-
Reference photographs
-
Intended placement or use
-
Budget and delivery deadline
-
Design direction
-
Number of revisions
-
Production and shipping timeframe
Work begins only after the agreed payment or deposit has been received.
Design approval
Where a sketch, digital proof or written concept is provided, you are responsible for checking names, dates, spelling, colours, dimensions and other details before approving it.
Changes requested after approval may:
-
Incur an additional charge;
-
Extend the completion date; or
-
Be declined if production has progressed too far.
Creative interpretation
Commissioning an original artwork involves artistic interpretation. While we will follow the agreed brief, the final handmade result will reflect Pradeepa’s artistic style and may not be an exact reproduction of a digital proof or reference image.
Cancellation of custom work
Because custom and personalised products are made specifically for you, cancellation and change-of-mind returns may not be available after work has begun, except where required by applicable law.
Any non-refundable deposit, design charge or material cost will be communicated before work starts.
This does not affect your rights if a product is faulty, damaged, materially different from the approved specification or otherwise does not conform to applicable law.
Customer-supplied material
You confirm that you have the necessary permission to provide and use any photograph, name, logo, quotation, design or other material submitted for a commission.
We may decline requests that infringe copyright, trade marks, privacy rights or other legal rights.
9. Shipping and delivery
Physical orders are prepared and dispatched from Gujarat, India unless otherwise stated.
Processing time and courier transit time are separate. Handmade, made-to-order, personalised and bulk products may require additional production time.
Estimated delivery dates are not guaranteed unless we expressly agree to a guaranteed delivery service in writing.
Delivery may be affected by circumstances outside our reasonable control, including:
-
Customs procedures
-
Courier disruption
-
Public holidays
-
Weather
-
Strikes
-
Transport restrictions
-
Security checks
-
Incorrect or incomplete addresses
-
Events of force majeure
Full delivery information is provided in our Shipping Policy:
www.anubhutibypradeepa.com/english-shipping-policy
10. International orders, customs and import charges
International customers are responsible for confirming that the ordered products may lawfully be imported into their destination country.
Unless checkout expressly states otherwise:
-
International orders are shipped from India;
-
Import taxes and duties are not included in the product price;
-
The recipient is responsible for import VAT, customs duty, brokerage and local handling charges;
-
The recipient may be treated as the importer of record; and
-
Customs clearance may delay delivery.
Customs authorities or courier companies may request identification, tax details, payment or additional documentation from the recipient.
We do not control or receive customs charges and cannot predict their amount.
If a parcel is refused, remains unclaimed or is returned because the recipient does not pay applicable charges, any refund will be assessed after the parcel is safely returned. Original shipping, return shipping, customs expenses and other unrecoverable costs may be deducted where permitted by law.
11. Delivery addresses and failed delivery
You are responsible for providing a complete and accurate delivery address, including the correct postal code, telephone number and recipient name.
Contact us immediately if you notice an error. We cannot guarantee that an address can be changed after processing or dispatch has begun.
If an order is returned because of:
-
An incorrect or incomplete address
-
Repeated failed delivery attempts
-
Failure to collect the parcel
-
Refusal of delivery
-
Failure to complete customs requirements
we may charge the cost of reshipping or deduct reasonable unrecoverable costs from any refund, where permitted by law.
12. Cancellations, returns and refunds
Returns, replacements and refunds are governed by our Refund Policy:
www.anubhutibypradeepa.com/english-refund-policy
Different rules may apply to:
-
Ready-made, non-personalised products
-
Personalised or made-to-order products
-
Original commissioned artwork
-
Damaged or faulty products
-
Incorrectly supplied products
-
Digital products
-
Workshop and event bookings
Nothing in these Terms excludes or restricts a mandatory consumer right that applies in your country and cannot lawfully be excluded.
Customers in some jurisdictions may have a statutory cooling-off or cancellation period for eligible online purchases. These rights may not apply to products made to the customer’s specifications or clearly personalised, subject to applicable law.
Where a lawful change-of-mind return is accepted, the customer may be responsible for return postage if they were informed of this before purchase.
13. Damaged, faulty or incorrect products
Please inspect your order promptly after delivery.
If an item arrives damaged, faulty or incorrect, contact us as soon as reasonably possible at anubhuti.by.pradeepa@gmail.com.
Please include:
-
Your order number
-
A description of the issue
-
Clear photographs of the product
-
Photographs of the outer packaging
-
A photograph of the shipping label
An opening or unboxing video is strongly encouraged because it can help us assess damage and support a courier claim. However, the absence of a video does not automatically remove any mandatory legal rights you may have.
Keep the product and its packaging until we confirm whether they are required for inspection, return or a courier claim.
Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, refund or another agreed resolution.
14. Care and use of products
You are responsible for following the care instructions shown on the product page, packaging or accompanying material.
Hand-painted and handmade products may require gentle handling. Unless a listing expressly confirms otherwise:
-
Do not place a product in a dishwasher, microwave or oven;
-
Do not soak painted or decorated surfaces;
-
Do not use abrasive cleaners;
-
Keep MDF, paper and other moisture-sensitive items dry;
-
Keep decorative items away from open flames and excessive heat;
-
Do not treat decorative products as toys.
Functional use, food contact, heat resistance and washing instructions depend on the individual product description.
Products containing small parts should be kept away from young children unless adult supervision is provided.
15. Workshops, events and creative sessions
Workshop descriptions will state the date, time, location, format, price and included materials.
Unless expressly described otherwise, Anubhuti workshops are creative and educational experiences. References to mindfulness, relaxation or wellbeing do not constitute medical, psychological, psychiatric or therapeutic advice or treatment.
Participants remain responsible for:
-
Disclosing relevant allergies or accessibility requirements;
-
Using tools and materials according to instructions;
-
Supervising any accompanying minor where permitted;
-
Arriving at the stated time; and
-
Following reasonable venue and safety requirements.
Workshop cancellation, transfer and refund conditions will be displayed during booking or communicated in the confirmation.
We may reschedule or cancel a workshop because of insufficient attendance, illness, venue problems, safety concerns or circumstances outside our control. If we cancel and cannot offer a suitable replacement, the workshop fee will be refunded.
Reasonable photographs or videos may be taken at an event only in accordance with the notice and consent arrangements communicated to participants. You may tell us if you do not wish to be included.
16. Intellectual property
All rights in the website and Anubhuti materials belong to Anubhuti by Pradeepa or the relevant rights holder, including:
-
Original mandala designs
-
Artwork
-
Product designs
-
Photographs and videos
-
Written content
-
Workshop material
-
Downloadable material
-
Logos, branding and graphics
Unless we give written permission, you may not copy, reproduce, trace, modify, publish, sell, license, distribute or commercially exploit this material.
Purchasing a physical artwork or commissioned piece transfers ownership of that physical item only. Copyright and reproduction rights remain with Anubhuti by Pradeepa unless a separate written agreement expressly transfers or licenses those rights.
A purchased product may be used for personal purposes but may not be reproduced or used commercially without written permission.
17. Commission photographs and portfolio use
We may photograph completed artwork for business records and quality documentation.
We will not intentionally publish identifiable customer photographs, private information or sensitive personalisation without appropriate permission.
Unless confidentiality is agreed in writing, we may display non-sensitive images of completed work in our portfolio, website or social media. You may request confidentiality before work begins, particularly for surprise gifts, private commissions or unreleased corporate projects.
18. Reviews, testimonials and customer content
If you submit a review, testimonial, photograph or other content for publication, you confirm that:
-
The content is truthful and based on your genuine experience;
-
You have the right to provide it;
-
It does not violate another person’s privacy or intellectual-property rights; and
-
It is not unlawful, defamatory or misleading.
Where you expressly consent to publication, you grant us permission to display the submitted content, your first name and associated rating on our website and marketing channels.
You may withdraw consent for future use of identifiable testimonial content by contacting us. Withdrawal will not necessarily affect use that occurred lawfully before the request.
We may decline or remove unlawful, abusive, fraudulent, irrelevant or privacy-infringing content. We will not remove a genuine negative review merely because it is unfavourable.
19. Acceptable website use
You must not:
-
Use the website for unlawful or fraudulent purposes
-
Attempt to gain unauthorised access to the website or another user’s account
-
Introduce viruses, malware or harmful code
-
Scrape or systematically extract website content without permission
-
Interfere with the website’s operation or security
-
Use Anubhuti artwork or branding to misrepresent an association with us
-
Submit false reviews, payment information or claims
We may restrict access or cancel an account where reasonably necessary to protect the website, customers or business.
20. Third-party services and links
The website may use or link to third-party services, including Wix, payment providers, courier companies, social-media platforms, map services and review providers.
Third-party services operate under their own terms and privacy policies. We are not responsible for independent websites or services that we do not control.
The presence of a link does not necessarily mean that we endorse all content or activities of the linked service.
21. Website availability
We aim to keep the website available and accurate but do not guarantee uninterrupted or error-free access.
We may temporarily suspend or modify parts of the website for maintenance, security, technical problems or business updates.
This does not affect obligations relating to orders we have already accepted.
22. Liability
Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud or any mandatory consumer remedy.
To the extent permitted by law, we are not responsible for:
-
Indirect or unforeseeable loss
-
Loss caused by incorrect information supplied by the customer
-
Delays outside our reasonable control
-
Customs decisions or charges
-
Misuse of a product
-
Failure to follow care or safety instructions
-
Independent acts or failures of third-party platforms
For purchases made primarily for business purposes, our total liability relating to an order will not exceed the amount paid for the affected product or service, except where the law does not permit such a limitation.
These limitations do not reduce the rights of consumers where those rights cannot legally be restricted.
23. Force majeure
We are not responsible for delay or failure caused by events outside our reasonable control, including natural disasters, severe weather, fire, epidemic, war, civil disturbance, government restrictions, customs action, transport disruption, strikes, power failure, internet failure or courier interruption.
We will take reasonable steps to minimise the effect and communicate material delays.
24. Privacy and cookies
Personal information is handled in accordance with our Privacy Policy:
www.anubhutibypradeepa.com/english-privacy-policy
The website may use essential and optional cookies. Where required, optional analytics or marketing cookies will be used according to the choices made through our cookie-consent tool.
Transactional communications relating to an order are separate from optional marketing communications.
25. Changes to these Terms
We may update these Terms to reflect changes in our products, services, business practices or legal obligations.
The version applying to an order is normally the version available when the order is placed, unless a change is required by law.
The effective date at the top of this page will be updated whenever these Terms materially change.
26. Governing law and disputes
These Terms are governed by the laws of India, subject to any mandatory consumer protection that applies in the customer’s country of residence and cannot lawfully be excluded.
We encourage you to contact us first so that we can try to resolve any concern fairly and promptly.
Subject to applicable mandatory consumer rights, disputes will be subject to the jurisdiction of the competent courts in Gujarat, India.
Nothing in this clause prevents a customer from exercising a mandatory right to bring a claim in another competent jurisdiction where applicable law permits it.
27. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.
The affected provision will be interpreted or adjusted only to the minimum extent necessary to make it lawful and enforceable.
28. No waiver
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
29. Entire agreement
These Terms, together with the applicable product description, order confirmation, quotation, Privacy Policy, Shipping Policy and Refund Policy, form the agreement between you and Anubhuti by Pradeepa.
For a custom, corporate or bulk order, a signed quotation or separately agreed written term will take priority where it expressly differs from these general Terms.
